Résumé en français: Dans cette thèse, j’emploie une conceptualisation foucaldienne afin d’analyser la manière dans laquelle les droits humains sont mobilisés en tant qu’outils de domination et outils de résistance. Avec cette conceptualisation j’analyse comment cette utilisation de manière instrumentaliste façonne l’entreprise en tant que sujet dans le (dés-)ordre global – avec une focalisation sur l’histoire, la sphère digitale et l’économie politique. Avec cette analyse, je fournis deux contribution importantes: Premièrement, j’utilise la pensée de Foucault afin de conceptualiser pouvoir et droits humains. Deuxièmement, j’utilise le pluralisme juridique afin de dépasser le désintérêt réductif que Foucault attribuait au droit parce qu’il le voyait seulement lié au pouvoir souverain. Par le biais de ces contributions, on comprend la fragmentation du sujet dans l’ordre global. English Summary: In this thesis, I use a Foucauldian understanding of power in order to analyse how human rights are mobilized as tools for domination and resistance. With this conceptualization, I analyse how such an instrumentalist use of human rights shapes the corporation as a subject in the global (dis-)order – with a focus on a historical perspective, the digital sphere and political economy. With this analysis I produce two major contributions: Firstly, I use Foucault’s thought for the conceptualization of power and conceptualization of rights. Secondly, I use legal pluralism in order to push beyond Foucault, to overcome his own reductive dismissal of law as only linked to sovereign power. Through these contributions I make sense of the fragmentation of the subject in the global order.
