Abstract

The purpose of this research is, therefore, to rethink the position of international law on nationality in two fundamental ways. First, by moving the point of departure of the international law of nationality towards a position more sensible of human rights and away from the logic of diplomatic protection. Secondly, by attacking the idea that only elements of nationality affecting inter-state relations are of relevance to international law.
