Abstract

The draft Chapter traces how the regulation of weapons under international law has become humanized. It suggests that the obligation to conduct legal weapon reviews is aimed at both ensuring respect for international humanitarian law and preventing violations of human rights, and that it should be understood as an obligation of due diligence. It further considers the humanization of the methodology used to identify customary rules.
