Abstract

The thesis analyses the prohibition of discrimination against trans persons in the work of the European Court of Human Rights and the Committee on the Elimination of All Forms of Discrimination Against Women. Based on this analysis, we envisage a shift toward a more fluid and complex definition of gender with regard to gender discrimination. Finally, the thesis investigates a new legal framework of intersectional discrimination drawing upon anti-categories approaches to non-discrimination.
