Abstract

This thesis seeks to foreground the silences, the suppressed and the excluded in international judicial argumentation through an analysis of the case law of international courts and tribunals. Through a study of different arguments and argumentative techniques, it aims to show how international lawyers as a collective come to disattend certain things in their judgments and written pleadings, the reasons that explain such exclusions, as well as their broader consequences.
