Abstract

"This thesis examines the legal regime applicable to individual rights under international law: in particular, whether inter-State norms of general international law apply to individual rights. The thesis suggests that we need a theory that reserves a role for general international law but that takes the rights of non-State actors seriously. Using investment treaties as its main case study, the thesis suggests conceptualizing treaties that create individual rights as stipulation pour autrui.
