Abstract

The thesis describes, explains, analyzes and evaluates change in investment treaty law through the lense of treaty design. Recently, a new generation of investment treaties has emerged that differs markedly from earlier agreements. These treaties (1) have a broader functional scope addressing investment in its wider policy context, (2) are based on a complex interplay of commitment and flexibility, (3) retract delegation from arbitral tribunals and (4) institutionalize interstate cooperation.
