States are in full control over migration in the ius ad migrationis.Yet,when an individual is under their jurisdiction,obligations stemming from human rights and refugee law are engaged creating a ius in migrationis.Effective protection for smuggled and trafficked migrants suffers from the tension between these two dimensions and the security aspects of modern migratory flows.
