Abstract

The project explores transnational legal processes in lawmaking, transplanting, and enforcement. Section 1 documents the endogenous birth of a global rule - the CRS and shows how transnational database generates regulatory efforts as a global law. Section 2 shows the interactions and conflicts of the transnational and national legal orders on a new power with an exogenous global rule by a mirror, autonomous or glocalism. Section 3 explores legal enforcement by the transnational concept of law. The practitioners make a law in consensus, which serves as de facto enforceable law.
