Foreign state immunity and denial of justice: jurisdictional rules, rights and conflict

This thesis submits that the scope of foreign States’ right to jurisdictional immunity is determined by international rules on the allocation of jurisdiction among States. It thus submits that the concept of denial of justice, sanctioned by international practice, gives rise to an internationally recognised basis of jurisdiction capable of displacing the requirement of jurisdictional immunity.
