This research project, founded in empirical research, will develop a theory on how certain norms become jus cogens norms and in which specific ways jus cogens norms create effects. The aim is to provide an empirically sound and comprehensive conception of jus cogens and its creation, to explain the distinctive functions of peremptory norms, and to assess the implications on the larger picture of international legal genealogy.
