Abstract

The paper submitted is rather an embryo of a chapter. It jots down ideas of central arguments I would like to pursue. States are in full control over migration in the ius ad migrationis.Yet,when an individual is under their jurisdiction,obligations stemming from human rights and refugee law are engaged creating a ius in migrationis.Effective protection for smuggled and trafficked migrants suffers from the tension between these two dimensions and the security aspects of modern migratory flows.
